Dr.Jayakumar’s release and the ‘Rule of Law’ of Najib



The Barisan National succumbed, to the tremendous unprecedented pressure of the people; the omnipresence of candle light vigil, the outpouring of hate to the government in the social media and the alternative media and the hunger strike which was announced yesterday, supposedly the hay which broke the camel’s back, for the long waited release of the six PSM detainees. Today 29th July at 2011 at 5.30 pm they were released unconditionally at Sentul Police Headquarters. The six are Sungai Siput MP Dr Michael D Jeyakumar, PSM deputy president M Sarasvathy, central committee members Choo Chon Kai and M Sukumaran, Youth chief R Saratbabu and Sungai Siput branch secretary A Letchumanan.



They were detained under section 122 of the Penal Code on the 25th of June which reads “Whoever collects or attempts to collect men, arms or ammunition, or otherwise prepares to wage war with the intention of either waging or being prepared to wage war against the Yang Di Pertuan Agong or any of the Rulers or the Yang Di Pertua Negeri or abets the waging or the preparation of such war, shall be punished with imprisonment for life or imprisonment for a term not exceeding twenty years, and shall also be liable to fine.” Just for distributing flyers for the rally.

Dr.Jayakumar and five of their comrades were rearrested at 1.20pm on Saturday 1st July 2011, under Section 3(1) of the Emergency (Public Order and Prevention of Crime) Ordinance 1969  which reads ,” Any person arrested and detained under this section may be detained in police custody for a period not exceeding sixty-days without an order of detention having been made in respect of him under section 4 (1) and can be detained with the Ministers pleasure for two years or until he deemed it necessary ”at Kepala Batas Police Station Penang. 

After his release, he spoke to his supporters at Kuala Lumpur and Selangor Chinese Assembly Hall, which gave him a rousing welcome and thanked the people’s solidarity and said his release was definitely because of pressure from the public. “After over one month, there was no sign that public support for us was abating; in fact, it was going to escalate. People walking, people fasting all over the place, it was getting too big for them,” he continued.



“It was not because the police came to their senses or they became honest and professional. They were not,” he said. He insisted that the police were bent on keeping the PSM 6 detained as a way to scare other Malaysians from voicing their dissent.“But it did not work. The people were brave and it was be they (Barisan Nasional) were losing so much popularity and support from the people that it just became too politically costly for them to keep holding us,” he told reporters after addressing a crowd of supporters at the Kuala Lumpur and Selangor Chinese Assembly Hall (KLSCAH, he said.

Barisan National has been demonized both by its people and the International community for its handling of the Bersih Rally, which is seeking reform from the fraudulent Election Commission. Hundreds of innocent people were arrested for wearing yellow T shirts, and extreme police brutality were unlashed to muffle the rally. But the government justified the arrest, and used it’s media to portray the participants as evil, accusing them for working under Communist, Jewish and International Christian NGO’s in creating anarchy in the country.

But irreparable damaged has already has been done to the credibility of Barisan Nasional by the way they suppressed dissent, couple with this it has now fallen to it’s the own internal bickering and conspiracies. Barisan National will be calling for an imminent General Election any time now, which is widely expected to erode its popularity in the ballot box and to perform even badly than the Mar 2008 election.
